The petition is said to seek legal remedies against those involved in creating, publishing or distributing such content online. Apart from personality rights concerns, the actress has also alleged violation of her moral rights under the Copyright Act, 1957. Through legal action, he is seeking protection against the continued dissemination of controversial material.
Bombay High Court allowed
The matter was recently heard by a single judge bench of Justice Abhay Ahuja. After considering the application, the court granted permission which allowed Preeti to proceed with an injunction case. The order is significant as it clears the way for the actress to take formal legal action against the named respondents in the matter. During the hearing, the court also considers jurisdictional issues. Since several companies linked to the case are said to be located outside Mumbai, questions have arisen about the appropriate forum for the trial. The court observed that some of the alleged activities were linked to online platforms operating at multiple locations. It also noted that several respondents maintained offices outside the territorial limits of Mumbai. Despite these reasons, the court granted the necessary leave and clarified that the matter would be empowered to hear and decide. As a result of this order, the case may go before the Bombay High Court.
